1. The Website Is Not Medical Advice

Content on the Website, including treatment descriptions, pricing, blog articles, frequently asked questions, images, scans, and other materials, is provided for general informational purposes only. It is not medical advice, a diagnosis, or a recommendation that any treatment is appropriate for you.

Using the Website, submitting a form, or communicating with us online does not create a provider–patient relationship. A provider–patient relationship is established only after an in-person or otherwise appropriate clinical evaluation by a licensed Nexa Med Spa provider.

Always seek the advice of a qualified health care professional about a medical condition or treatment decision. Do not disregard or delay professional medical advice because of something you read on the Website.

2. Medical Emergencies

The Website, online forms, email, social media, and text messaging are not monitored for emergencies. Do not use them to report an emergency or an urgent medical concern.

If you believe you are experiencing a medical emergency, including a reaction after treatment, call 911 or go to the nearest emergency department.

3. Eligibility

The Website is intended for adults. By using it, you represent that you are at least 18 years old, or that you are using it with the involvement and consent of a parent or legal guardian.

Services for a minor require the consent of a parent or legal guardian and are subject to applicable law and provider discretion. Some services are not available to minors.

4. Consultations, Candidacy, and Treatment

Every treatment at Nexa Med Spa begins with an assessment. Your provider determines whether a service is appropriate for you based on your goals, health history, examination, and, where applicable, laboratory results or imaging.

• Nexa Med Spa and its providers may decline, postpone, modify, or discontinue a treatment when, in their professional judgment, it is not appropriate or safe for you.
• Treatment requires your informed consent, which will be obtained separately before treatment.
• You agree to provide complete and accurate information about your medical history, medications, allergies, pregnancy or nursing status, prior treatments, and any other information your provider requests, and to update it when it changes.
• You agree to follow pretreatment and aftercare instructions and to contact us promptly with questions or concerns after treatment.

Results vary from person to person and are not guaranteed. The number of sessions, units, or products needed, the timing of results, and how long results last depend on individual factors and cannot be promised in advance.

5. Online Requests and Forms

Submitting a consultation request, contact form, or other online form is a request only. It does not confirm an appointment, guarantee availability, or establish a provider–patient relationship. An appointment is confirmed only when Nexa Med Spa confirms it with you.

You agree that information you submit through the Website is accurate, current, and your own, or that you are authorized to submit it.

Please do not submit detailed health information through a general website form, email, social media message, or other channel that is not identified as a secure patient communication method. Your provider will review your health history with you privately.

6. Appointments, Cancellations, and Late Arrivals

Appointments are subject to availability. Nexa Med Spa may require a deposit or a payment method on file to reserve certain appointments.

Cancellations, rescheduling, late arrivals, and missed appointments are governed by the appointment and financial policies provided to you at booking or at the clinic. Those policies may include fees or the forfeiture of a deposit, session, or credit. We may shorten or reschedule an appointment when you arrive late so that we can stay on time for other guests.

Nexa Med Spa may need to reschedule or cancel an appointment because of provider availability, equipment issues, weather, safety concerns, or other circumstances. When that happens, we will make reasonable efforts to notify you and offer another time.

7. Pricing, Payment, and Promotions

Prices shown on the Website are provided for general reference, may change for future purchases, and do not constitute an offer. Your price is confirmed by Nexa Med Spa before treatment, based on the treatment plan, products, units, or sessions your provider recommends.

• Prices marked with an asterisk (*) may change for future purchases. Changes affecting an active membership or prepaid package follow the terms of your agreement and any notice it requires.
• Per-unit, per-syringe, per-area, and per-session pricing does not indicate how many units, syringes, areas, or sessions you will need.
• Promotions, credits, and discounts are subject to the terms stated with them, are available for a limited time, may not be combined unless stated, have no cash value, and may be changed or ended at any time where permitted by law.
• Applicable taxes are your responsibility.

Payment is due at the time of service unless another arrangement is agreed in writing. Payments may be processed by third-party payment processors, and financing may be offered by third-party lenders. Those providers’ terms and privacy policies apply to their services, and Nexa Med Spa is not a lender.

Refunds, credits, and exchanges are governed by the financial policies provided to you at the clinic and by applicable law. Because services are personalized and performed by licensed professionals, completed services are generally not refundable.

8. Memberships and Packages

Memberships and packages are governed by the agreement you sign or accept at enrollment, including any minimum commitment, billing frequency, renewal terms, cancellation requirements, included benefits, and expiration of unused sessions or credits. Descriptions on the Website are summaries only; the enrollment agreement controls.

Unless your agreement states otherwise, memberships and packages are personal to you, may not be transferred or shared, and have no cash value. Membership benefits apply only while your membership is active and in good standing.

9. Prescription Medications and Wellness Programs

Prescription medications, including those used in weight, hormone, peptide, sexual wellness, and recovery programs, are prescribed only when a licensed provider determines, after an appropriate evaluation, that they are clinically appropriate for you. Eligibility is not guaranteed, and laboratory testing, follow-up visits, or monitoring may be required to begin or continue a program.

Some medications may be compounded by a licensed pharmacy. Compounded medications are not approved by the U.S. Food and Drug Administration. Your provider will discuss the medication, its source, its risks, and alternatives with you.

You agree to use prescribed medications only as directed, only for yourself, and to report side effects or changes in your health promptly. Medications that have been dispensed generally cannot be returned or refunded, consistent with applicable pharmacy law.

10. Images, Scans, Testimonials, and Examples

Photographs, illustrations, scan images, and example results on the Website are provided to explain treatments and technologies. Some images are illustrative, stock, or computer-generated and do not depict Nexa Med Spa patients. Example scans and results are not a promise or prediction of your results.

Reviews and testimonials reflect the individual experiences of the people who wrote them. They are not typical or guaranteed results, and they are not medical advice.

Nexa Med Spa will not use a patient’s photographs, scans, or testimonials for marketing without the patient’s written authorization.

11. Text Messages and Electronic Communications

By providing your contact information and consenting, you agree that Nexa Med Spa may contact you about your request, appointments, and services by telephone, email, or text message, as described in our Privacy Policy.

Text messages may include appointment reminders and related service messages. Message frequency varies by appointment activity. Message and data rates may apply. Reply STOP to opt out at any time or HELP for help. Consent to receive marketing text messages is not a condition of any purchase or service.

You agree to provide a telephone number that you are authorized to use and to notify us if it changes. Email and standard text messages may not be encrypted; do not use them to send detailed health information.

12. Privacy

Your use of the Website is also governed by our Privacy Policy. Protected health information is handled in accordance with HIPAA, other applicable law, and our Notice of Privacy Practices.

13. Acceptable Use

You agree not to:

• Use the Website for any unlawful, fraudulent, or harmful purpose;
• Submit false, misleading, or another person’s information without authorization;
• Impersonate any person or misrepresent your affiliation with any person;
• Interfere with, disrupt, or attempt to gain unauthorized access to the Website, its servers, or related systems;
• Introduce malware, viruses, or other harmful code;
• Use bots, scrapers, or other automated means to access, copy, or collect content or information from the Website, except as permitted by a published robots.txt file for general search indexing;
• Use the Website to send spam or unsolicited communications;
• Harass, threaten, or abuse Nexa Med Spa personnel, patients, or other users; or
• Copy, frame, or reproduce the Website or its content except as permitted by these Terms.

We may suspend or restrict access to the Website, decline a request, or take other appropriate action if we reasonably believe you have violated these Terms.

14. Intellectual Property

The Website and its content, including text, graphics, photographs, videos, designs, logos, the Nexa Med Spa name and marks, and the selection and arrangement of content, are owned by or licensed to Summit Lifestyle LLC and are protected by copyright, trademark, and other laws.

You may view and print Website content for your personal, noncommercial use. You may not otherwise copy, modify, distribute, sell, publish, or create derivative works from Website content without our prior written permission.

Product and device names referenced on the Website, including BOTOX®, Xeomin®, Dysport®, JUVÉDERM®, HydraFacial®, Morpheus8, and others, are trademarks of their respective owners. Their use does not imply endorsement of Nexa Med Spa by those owners.

15. Your Submissions and Feedback

If you send us comments, suggestions, reviews, or other feedback about the Website or our services, you grant Nexa Med Spa a nonexclusive, royalty-free right to use that feedback to operate and improve our business. We will not publicly attribute feedback to you, or use your name, image, or health information, without your permission.

16. Third-Party Websites and Services

The Website may link to or integrate with third-party websites and services, such as booking platforms, patient portals, payment processors, financing providers, map services, review sites, and social media platforms. Those services are governed by their own terms and privacy policies.

Nexa Med Spa does not control and is not responsible for the content, availability, security, or practices of third-party services that it does not operate. A link does not imply endorsement.

17. Accuracy and Availability of the Website

We work to keep the Website accurate and current, but it may contain typographical errors, inaccuracies, or outdated information, including about pricing, availability, providers, hours, or services. We may correct errors and update content at any time without notice.

We do not guarantee that the Website will be available at all times, uninterrupted, secure, or free of errors or harmful components. We may modify, suspend, or discontinue any part of the Website at any time.

18. Disclaimers

To the fullest extent permitted by law, the Website and its content are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

This section applies to the Website and its content. It does not limit any duty of care that Nexa Med Spa or its licensed providers owe to patients in providing clinical services, which is governed by applicable law.

19. Limitation of Liability

To the fullest extent permitted by law, Nexa Med Spa and its owners, officers, employees, providers, contractors, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of, or inability to use, the Website or its content.

To the fullest extent permitted by law, the total liability of Nexa Med Spa for any claim arising out of or related to your use of the Website will not exceed one hundred U.S. dollars (US $100).

This section does not limit liability for claims arising from clinical services or professional care, which are governed by applicable law, including Indiana law governing medical malpractice claims. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

20. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Nexa Med Spa and its owners, officers, employees, providers, contractors, and agents from claims, losses, and expenses, including reasonable attorneys’ fees, arising out of your violation of these Terms, your misuse of the Website, or your submission of information you were not authorized to provide.

21. Governing Law and Venue

These Terms and any dispute arising out of or related to them or to your use of the Website are governed by the laws of the State of Indiana, without regard to its conflict-of-laws rules.

Any action arising out of or related to these Terms or the Website must be brought exclusively in the state courts located in Johnson County, Indiana, or the United States District Court for the Southern District of Indiana, and you consent to the personal jurisdiction of those courts. This section does not prevent either party from seeking relief in small claims court where its jurisdictional requirements are met.

Nexa Med Spa is committed to making the Website accessible to people with disabilities. If you have difficulty accessing any part of the Website, or need information in another format, contact us using the information below and we will work with you to provide the information or service you need.

23. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, the Website, or legal requirements. The revised Terms will be posted with an updated “Last Updated” date and apply from that date. Your continued use of the Website after an update means you accept the revised Terms.

Changes to these Terms do not alter a signed consent form, financial policy, or membership or package agreement unless that document provides otherwise.

24. General Terms

• Entire agreement. These Terms, together with the Privacy Policy and the documents referenced in them, are the entire agreement between you and Nexa Med Spa regarding the Website.
• Severability. If any provision is found unenforceable, it will be enforced to the maximum extent permissible, and the remaining provisions will remain in effect.
• No waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.
• Assignment. You may not assign these Terms without our consent. Nexa Med Spa may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.
• Headings. Section headings are for convenience only and do not affect interpretation.
